Anyway, got a message over on the Facebooks from T. Casey Brennan, yeah, THAT T.Casey Brennan:
Why the Cerebus fan community needs a new action figure -- DANDY THE AARDVARK by T. Casey Brennan Marvel is famous for stealing the names and costumes of characters they don't own -- then trademarking them so the original can no longer be published. Spider-Ham

He continued:
was designed to look like Cerebus. A few more tactical moves by Marvel could finish Cerebus. If that happens, Dave will have to stop producing Cerebus comics, etc. That leaves Dandy the Aardvark, Cerebus's predecessor and Dandy CAN take up the gap. We need Dandy action figures. Now.

I faxed all that up to Dave, with this addition from me:
As I’ve said before, Spider-Ham looks more like Porky Pig in a Spider-Man suit than Cerebus in a Spider-Man suit these days.

Can’t be right, surely.
What characters have Marvel stolen?
And: shouldn’t it be a matter of record that a given character existed before a knock-off?

I don't think it's like adverse possession in real estate. I think the only potential issue would be for Marvel, if Dave had any interest in enforcing the copyright.

I don't think it's such a stretch to assume that Spider-Ham was in some way visually influenced by Cerebus. They would have been on the comic rack at the same time and there's a lot of friendly references in X-Men (not to mention the Sym, character from Inferno).
